De israelische Terreur 983

War Criminals Are Becoming The Arbiters Of Law
By Paul Craig Roberts, October 12, 2009

[Paul Craig Roberts is the Senior Research Fellow at the Hoover Institution, Stanford University and a former editor and columnist for The Wall Street Journal and columnist for Business Week From 1982 through 1993. During 1981-82 he served as Assistant Secretary of the Treasury for Economic Policy in President Reagan's administration]

The double standard under which the Israeli government operates is too much for everyone except the brainwashed Americans. Even the very Israeli Jerusalem Post can see the double standard displayed by "all of Israel now speaking in one voice against the Goldstone report":

"This is the Israeli notion of a fair deal: We're entitled to do whatever the hell we want to the Palestinians because, by definition, whatever we do to them is self-defense. They, however, are not entitled to lift a finger against us because, by definition, whatever they do to us is terrorism. That's the way it's always been, that's the way it was in Operation Cast Lead. And there are no limits on our right to self-defense. There is no such thing as 'disproportionate.' We can deliberately destroy thousands of Gazan homes, the Gazan parliament, the Ministry of Justice, the Ministry of Interior, courthouses, the only Gazan flour plant, the main poultry farm, a sewage treatment plant, water wells and God knows what else.
Deliberately.
Why? Because we're better than them. Because we're a democracy and they're a bunch of Islamo-fascists. Because ours is a culture of life and theirs is a culture of death. Because they're out to destroy us and all we are saying is give peace a chance.
The Goldstones of the world call this hypocrisy, a double standard. How dare they! Around here, we call it moral clarity."

A person would never read such as this in the New York Times or Washington Post or hear it from any US news source. Unlike Israeli newspapers, the US media is a complete mouthpiece for the Israel Lobby. Never a critical word is heard. This is the way the syllogism works:

It is anti-semitic to criticize Israel. Anti-semitism is a hate crime. Therefore, to criticize Israel is a hate crime.

Britain's ambassador to the United Nations, John Sawers, stepped into the hate crime arena when he told Israel Army radio that the Goldstone report on Israel's military assault on Gaza contains "some very serious details which need to be investigated." A year from now when the Anti-Defamation League has its phalanx of US Department of Justice (sic) prosecutors in place, Sawers would be seized and placed on trial. Diplomatic immunity means nothing to the US, which routinely invades other countries, executes their leaders or sends them to the Hague for trial as war criminals.

Human Rights Watch was saddened to read that our founding chairman, Robert Bernstein, opposes holding Israel to the same standards that we apply to the rest of the world ("Lost in the Mideast," Views, Oct. 21). Human Rights Watch does not believe that the human rights records of "closed" societies are the only ones deserving investigation. If that were the case, we would not work on U.S. abuses in Guantánamo Bay, police abuse in Brazil, maternal deaths in India, or the ill-treatment of migrants in the E.U. "Open" societies and democracies commit human rights abuses, too, and Human Rights Watch has an important role to play in documenting those abuses.

Human Rights Watch has produced more than 1,700 reports, letters, news releases and other commentaries on the Middle East and North Africa since January 2000, and the vast majority of these were about countries other than Israel. Our Middle East division is only one of 16 research programs at Human Rights Watch. The work on Israel is a tiny fraction of Human Rights Watch's output.

It is not the case that Human Rights Watch had "no access to the battlefield" during and after the Israeli operation in Gaza in January 2009. We have a research assistant based in Gaza, and other researchers entered via the border with Egypt after the fighting and conducted interviews with victims, eyewitnesses, U.N. officials, local authorities and others. We also visited attack sites, analyzed ballistics evidence, and examined autopsy and other medical reports.

Mr. Bernstein would excuse these violations because they were supposedly committed in "self-defense" rather than "intentionally." But the Geneva Conventions prohibit abuses regardless of motivation. Moreover, many of Israel's actions showed evidence of official policy; the same was true of Palestinian rocket fire into Israeli towns. We've published reports on both.

In April 2009, Mr. Bernstein brought his concerns about our work on Israel to a full meeting of the Human Rights Watch board of directors. The board rejected his view that Human Rights Watch should report on only closed societies, and expressed its full support for the organization's work.

The Painted Word: "Realism does not lack its partisans, but it does rather conspicuously lack a persuasive theory. And given the nature of our intellectual commerce with works of art, to lack a persuasive theory is to lack something crucial--the means by which our experience of individual works is joined to our understanding of the values they signify."

Kennelijk is Rutger nooit in Rome geweest of Washington.

Jammer.

The Empire 485

Dear stan,

The effort to end mountaintop removal coal mining has never been stronger, and the pushback from Big Coal has never been harder -- or more dangerous to coalfield residents who stand in their way.

Last week, at hearings held in Kentucky and West Virginia by the Army Corps of Engineers on its proposal to end the streamlined "Nationwide 21" mountaintop removal coal mining permits, clean energy proponents were verbally and physically threatened by a large pro-coal crowd -- and were removed before the hearing by police for "security reasons."

You can watch video of the hearings and incident here:

The lives of residents brave enough to speak in favor of stronger enforcement of mountaintop removal coal mining are increasingly being threatened by angry mobs ginned up by the coal companies --but Congress can solve the problem by clearly making mountaintop removal illegal once and for all.

That's why, today, we're asking you to send a new email to your Representatives in Congress and to key decision makers -- from House Speaker Nancy Pelosi to EPA Chief Lisa Jackson. Last week, we reached a record 160 co-sponsors for the Clean Water Protection Act in the U.S. House of Representatives! House Speaker Pelosi and other decision makers need to hear from us: the time to pass the Clean Water Protection Act is right now.

Click here to send an email demanding the passage of the Clean Water Protection Act

And if you haven't done so already, please also take a moment to send the Army Corps of Engineers an email telling them you support their efforts to end the streamlined permitting process for Big Coal. Supporters of clean energy may not have gotten a chance to speak at the hearings last week, but Big Coal can't silence all of us.

Send your comments to the Army Corps of Engineers here. Hurry! The public comment period ends October 26th.

Those who live in Appalachia and those who work in the mines all want to protect our land and people. However, propaganda and fear-mongering by coal executives are fueling the anger and tension felt by many coal supporters, and is a result of the momentum that has been building to end mountaintop removal.

Last week saw some great news for those of us who love mountains. On Friday, the EPA threatened to use its power under the Clean Water Act to veto the massive proposed Spruce No. 1 mountaintop removal coal mine in Logan Country, West Virginia. If the EPA follows through, this would mark only the 13th time the agency has used its veto power since 1972 -- and the first time it has used the power to block a coal-mining permit. Read more.

Also last week, the Raleigh County School Board in Coal River, West Virginia, announced its intention to ask the state for funds to construct a new school to replace the infamous Marsh Fork Elementary - which sits immediately below a 2.8 billion gallon coal sludge impoundment and a mountaintop removal mining site. Senator Robert Byrd and others from the West Virginia congressional delegation argued that Massey Energy (which owns the mine and impoundment) should pay for the new school. "These are children's lives we are talking about," Byrd said. Read more.

Children's lives are at stake, as are the mountains and communities of Appalachia. The time is now for leaders in Congress to send the Clean Water Protection Act to President Obama.

Click here to tell Congress to pass of the Clean Water Protection Act now.

Thank you for taking action.

Wie is Rutger Ponzen?

Zie: http://www.liwwadders.nl/data/nieuws/items/EkpZZkAklpsTkoqIeS.php

Rutger Ponzen? Ja, Rutger Ponzen! Wie mag in godsnaam Rutger Ponzen zijn? Daarover later meer and all will berevealed.

There must be somewhere out of here

said the joker to the thief

Topniveau

The Movement Against the Banks

By Ruth Conniff, October 21, 2009

A massive rally in Chicago next week aims to express public displeasure with the massive bank bailout outside the American Bank Association annual meeting. Protesters will converge at 11:30 on Monday, October 26, at 301 North Water Street, where the meeting is taking place.

"The same financial institutions that caused the economic crisis and took billions in taxpayer bailouts are back to earning incredible profits," rally organizers—including Public Citizen, the AFL-CIO, and Change to Win—declare. "Meanwhile, Americans face shrinking pensions, rising foreclosures and unemployment, state budget cuts, predatory lending, outrageous overdraft fees, and sky-high credit card interest rates."

Protesters will demand oversight and accountability and reforms that would rein in the banks. It is an important moment, since Congress takes up regulatory legislation, including the idea of a Consumer Financial Protection Agency, this month.

The Obama Administration is backing the idea of a consumer protection agency, but shying away from other reforms, including breaking up the "too-big-to-fail" banks and separating commercial banking activities from the investment activities that led to the current financial crisis. Today's New York Times includes a profile of Paul Volcker, the Federal Reserve chairman from 1979 to 1987, describing how he has been marginalized by Obama's pro-Wall Street economic advisors for suggesting a return to the 1933 Glass-Steagall Act, which, before deregulation, mandated that commercial banking and investment activities be separate.

"His disagreement with the Obama people on whether to restore some version of Glass-Steagall appears to have contributed to published reports that his influence in the administration is fading and that he is rarely if ever in the small Washington office assigned to him," the Times reports.

Meanwhile, Bankster, "your go-to site for updates on the financial services re-regulation fight in Congress and for progressive net-roots campaigning against the big boys on Wall Street"—is up and running.

The site, a project of the Center for Media and Democracy, aims to be the most comprehensive resource on the web for lay people who want to understand the battle for control over the financial services industry.

The site calls for criminal penalties for the bankers: "On the one-year anniversary of the Banksters blowing a hole in the global economy, no employee of a major American bank or financial institution is behind bars," Bankster points out. "Compare this to what happened after the Savings and Loan heist almost 20 years ago. No less than 1,852 S&L officials were prosecuted and 1,072 were jailed. Over 500 CEOs and top officers were indicted. What is going on here? Don't we believe in holding people accountable anymore? Tell the U.S. Department of Justice and the FBI to get cracking!"

Among the other citizens' groups featured on the site are the "10 percent is enough" campaign that brings together leaders from all the major world religions to oppose usurious interest rates on moral grounds.

And just in time for Halloween, the anti-death-bonds campaign focuses on an issue Michael Moore brought to light in his new movie, "Capitalism: A Love Story": employers and investment firms such as Goldman Sachs taking out life insurance policies on working people and naming themselves the beneficiaries, so they can benefit from your death.

All of these issues should galvanize public opposition to the banks' control of their own regulators in Washington. As Bankster puts it, "If you want to rein in the Banksters and if you think America deserves better than a ‘boom and bail’ economy, you need to muscle up and weigh in." Only engaged citizens can stop the banks.

Katholieken waren altijd al voor gele markeringen.'In Europe, the Fourth Council of the Lateran of 1215 ruled that Jews and Muslims must be distinguishable by their dress (Latin "habitus")", and the yellow badge in Europe dates from this, unlike the Jewish hat (or "Judenhut"), a cone-shaped hat, which is seen in many illustrations from before this date, and remained the key distinguishing mark of Jewish dress in the Middle Ages.[10] From the sixteenth century, the use of the Judenhut declined, but the badge tended to outlast it, surviving into the eighteenth century in places,[11] even longer in Imperial Russia.'

Letter from America

Imperialism, Goldman Sachs Style

Published: October 21, 2009

NEW YORK — Sooner or later, the Financial Crisis Inquiry Commission, created by Congress to investigate the causes of the recent and ongoing financial crisis, will no doubt examine the technical aspect of the financial collapse — low interest rates, credit default swaps, derivatives, cheap mortgages that ballooned and other factors that almost wrecked the global economy.

Probably among the many things the commission members will not do, however, is read “The Origins of Totalitarianism,” the 1951 book by the German-born political theorist Hannah Arendt, which at first glance would seem to be utterly detached from a crisis that took place more than three decades after the author’s death.

But the commission members, probably all products of a liberal education, would actually do well to read Arendt. Or, at least, that was the implicit argument of a group of political scientists, philosophers and even a couple of economists who gathered last weekend at Bard College, a bucolic spot about 90 miles, or 145 kilometers, from New York, to ask what Arendt’s writings could teach about the current crisis.

Quite a lot was the answer, though Arendt shared the stage with others from different places and times, most notably Thomas Hobbes, the 17th-century political thinker with whom Arendt closely identified.

The title of one panel — “Can Arendt’s Discussion of Imperialism Help Us to Understand the Current Financial Crisis?” — was typical of the conference, with its somewhat surprising assumption that Arendt, whose main concern was understanding the twin evils of Nazism and Communism, would have much relevance at all to a world dominated by what might be called Goldman Sachsism.

But what that panel discovered in Arendt’s writings on imperialism, which were part of her larger “Origins of Totalitarianism” work, actually echoes eerily and powerfully recent financial events.

The crucial point is that for Arendt, the era of imperialism, which she believed began in the 1870s and lasted until the outbreak of World War I in 1914, marked the moment when the economic principle of unlimited growth and expansion came to dominate politics. It was the point at which private people pursuing great wealth, in essence, seized political power and made the protection of their interests the policies of the state — and it’s not all that hard to see something like that happening today.

“After the disastrous financial swindles of the 1860s and ’70s, which were on a scale Bernie Madoff might admire, the need to protect their far-flung capital investments, and the huge profits derived from interest on them, inspired capitalists for the first time to ensure their enterprises, that is, to back them up with political power,” Jerry Kohn, the head of the Hannah Arendt Center at the New School for Social Research in New York, said in a paper he read at the conference.

Arendt was a German-Jewish scholar who escaped Nazism and spent much of her career teaching at American universities. She is probably best known to the general public for her phrase “the banality of evil,” which she coined while covering the trial of Adolf Eichmann in Jerusalem — her idea being that Eichmann’s evil illustrated not some sort of radical passion but rather a dull, bureaucratic obedience to authority.

But her career was spent in deep deliberation over the collapse of European civilization at the hands of both Nazism and Communism, and one of the key elements in that collapse was the replacement of the commitment to public virtue with the rampant pursuit of private interests. This led her, in her work on imperialism, to some statements that seem, in light of the financial collapse, to be remarkably prescient.

“For the first time,” she wrote, speaking of imperialism, “investment of power did not pave the way for investment of money, but export of power followed meekly in the train of exported money.”

Goldstone: Israel's missed opportunity

Israel's missed opportunity

My mission was determined to investigate war crimes in Gaza fairly.
The Israeli government was wrong to shut us out

o Richard Goldstone
o guardian.co.uk, Wednesday 21 October 2009 10.30 BST

Five weeks after the release of the report of the fact-finding
mission on Gaza, there has been no attempt by any of its critics to
come to grips with its substance. It has been fulsomely approved by
those whose interests it is thought to serve and rejected by those of
the opposite view. Those who attack it do so too often by making
personal attacks on its authors' motives and those who approve it
rely on its authors' reputations.

Israeli government spokesmen and those who support them have attacked
it in the harshest terms and, in particular my participation, in a
most personal and hurtful way. The time has now come for more sober
reflection on what the report means and appropriate Israeli reactions
to it.

I begin with my own motivation, as a Jew who has supported Israel and
its people all my life, for having agreed to head the Gaza mission.
Over the past 20 years, I have investigated serious violations of
international law in my own country, South Africa, in the former
Yugoslavia, in Rwanda and the alleged fraud and theft by governments
and political leaders in a number of countries in connection with the
United Nations Iraq oil-for-food programme.

In all of these, allegations reached the highest political echelons.
In every instance, I spoke out strongly in favour of full
investigations and, where appropriate, criminal prosecutions. I have
spoken out over the years on behalf of the International Bar
Association against human rights violations in many countries,
including Sri Lanka, China, Russia, Iran, Zimbabwe and Pakistan.

I would have been acting against those principles and my own
convictions and conscience if I had refused a request from the United
Nations to investigate serious allegations of war crimes against both
Israel and Hamas in the context of Operation Cast Lead.

As a Jew, I felt a greater and not a lesser obligation to do so. It
is well documented that as a condition of my participation I insisted
upon and received an even-handed mandate to investigate all sides,
and that is what we sought to do.

I sincerely believed that because of my own record and the terms of
the mission's mandate we would receive the co-operation of the
Israeli government. Its refusal to co-operate was a grave error. My
plea for co-operation was repeated before and during the
investigation, and it sits, plain as day, in the appendices of the
Gaza report for those who actually bother to read it.

Our mission obviously could only consider and report on what it saw,
heard and read. If the government of Israel failed to bring facts and
analyses to our attention, we cannot fairly be blamed for the
consequences. Those who feel that our report failed to give adequate
attention to specific incidents or issues should be asking the
Israeli government why it failed to argue its cause.

Israel missed a golden opportunity to actually have a fair hearing
from a UN-sponsored inquiry. Of course, I was aware of and have
frequently spoken out against the unfair and exceptional treatment of
Israel by the UN and especially by the human rights council.

I did so again last week. Israel could have seized the opportunity
provided by the even-handed mandate of our mission and used it as a
precedent for a new direction by the United Nations in the Middle
East. Instead, we were shut out.

As I stated in response to a recent letter from the mayor of Sderot,
I believed strongly that our mission should have been allowed to
visit Sderot and other parts of southern Israel that have been at the
receiving end of unlawful attacks by many thousands of rockets and
mortars fired at civilian targets by Hamas and other armed groups in
Gaza. We were prevented from doing so by, what I believe, was a
misguided decision by the Israeli government.

In Gaza, I was surprised and shocked by the destruction and misery
there. I had not expected it. I did not anticipate that the IDF would
have targeted civilians and civilian objects. I did not anticipate
seeing the vast destruction of the economic infrastructure of Gaza
including its agricultural lands, industrial factories, water supply
and sanitation works. These are not military targets. I have not
heard or read any government justification for this destruction.

Of course the children of Sderot and the children of Gaza have the
same rights to protection under international law, and that is why,
notwithstanding the decision of the government of Israel, we took
whatever steps were open to us to obtain information from victims and
experts in southern Israel about the effects on their lives of
sustained rocket and mortar attacks over a period of years. It was on
the strength of those investigations that we held those attacks to
constitute serious war crimes and possibly crimes against humanity.

The refusal of co-operation by the government of Israel did not
prevent us from reacting positively to a request from Gilad Shalit's
father to speak personally to our mission at its public session in
Geneva. No one who heard his evidence could fail to have been moved
by the unspeakable pain of a parent whose young son was being held
for over three years in unlawful circumstances without any contact
with the outside world and not even allowed visits from the
International Committee of the Red Cross. The mission called for his
release.

Israel and its courts have always recognised that they are bound by
norms of international law that it has formally ratified or that have
become binding as customary international law upon all nations. The
fact that the United Nations and too many members of the
international community have unfairly singled out Israel for
condemnation and failed to investigate horrible human rights
violations in other countries cannot make Israel immune from the very
standards it has accepted as binding upon it.

Israel has a strong history of investigating allegations made against
its own officials reaching to the highest levels of government: the
inquiries into the Yom Kippur war, Sabra and Shatila, Bus 300 and the
second Lebanon war.

Israel has an internationally renowned and respected judiciary that
should be envy of many other countries in the region. It has the
means and ability to investigate itself. Has it the will?

'U.S. to stand by Israel in the fight against Goldstone report'

President Peres on Wednesday harshly condemned the Goldstone report and told the U.S. envoy to the United Nations, Susan Rice that, "It is outrageous that a respected institution like the United Nations provides a platform to spread lies and stories about Israel."

The Goldstone report accuses Israel Defense Forces and Palestinian militants of war crimes and possible crimes against humanity during their Dec. 27-Jan. 18 conflict in the Gaza Strip.

The report also calls on the UN Security Council to refer the matter to the International Criminal Court at The Hague, which could prosecute Israeli officials for war crimes.

"The United Nations provides a stage for Ahmmadinejad, who threatens to annihilate Israel, and lets him stand judge," continued Peres. "This is nothing short of ridiculous."

Rice promised that the United States will continue to stand by Israel as a loyal friend in the fight against the Goldstone report.

Meanwhile, China said it would oppose discussing the Goldstone report at the United Nations Security Council, Chinese members of parliament told a delegation of visiting Israeli officials in Beijing on Wednesday.

China's declaration came in response to comments from Kadima MK Tzachi Hanegbi, who is heading the delegation from the Knesset Foreign Affairs and Defense Committee, and who harshly criticized China for voting in favor of a resolution endorsing the Goldstone report at the UN Human Rights Council session last Friday.

The Chinese officials emphasized that the UN Human Rights Council has enough tools to examine the issue closely without the involvement of additional UN institutions.

Earlier this week, Russian officials also declared Moscow's opposition to any discussion of the Goldstone Gaza report by the UN Security Council. This proclamation follows Russia's vote in favor of adopting the report at the Human Rights Council in Geneva last Friday.

"In my country we go to prison first and then become President."

Nelson Mandela

South Africa

Dear stan,

We're writing to you because you've already taken action to stop the imprisonment of these nonviolent heroes. We just got word in on their status and the news is not good. They need you to continue to take action.

The day before yesterday, a judge extended the detention ofMohammad Othman for yet another 11 days. He was detained on September 22 by Israeli authorities when returning to the West Bank after a trip to Norway, where he advocated for boycotts, divestments, and sanctions (BDS) against Israel. Since his detention, he has endured long interrogations and solitary confinement.

Over 8,000 people have written US President Obama, asking him to press Israel for his release.
Please keep fighting for his release, and get the latest on his case here:http://freemohammadothman.wordpress.com

Yesterday, Israeli activist Ezra Nawi was sentenced to one month in jail. Why? On July 22, 2007, he tried to stop a military bulldozer from destroying the homes of Palestinian Bedouins in the South Hebron region. The whole incident was documented on video, except for a few seconds when Ezra was inside the shack being demolished. Israeli Border Policemen claimed to have been hit by Ezra in these few seconds, and the judge, of course, took their word over Ezra's.

This should come as no surprise. The very same day of Ezra's sentencing, Israel's State Prosecutor's Office decided not to press charges against Border Guard policemen documented in a videohitting Palestinians, 'as they did not cause real damage.' (1)

While these Border Guards go free, Ezra Nawi goes to jail.

After over 20,000 of you wrote letters in Ezra's defense, the judge had tried to avert more bad publicity by encouraging Ezra to admit his guilt and take community service instead of prison time. Ezra could not admit a crime he did not commit, so rather than avoiding jail as a guilty person, he is going to prison as an innocent man.

Ezra was further ordered to pay a fine of NIS 750 and NIS 500 to each of the officers he was wrongfully convicted of assaulting. In addition, Ezra was given a conditional sentence of six months in prison, should he 'participate in similar activities' during the next three years.

In reaction to the sentence, settlers complained about 'the selectivity of law enforcement officials,' implying that the judge went too light on Nawi, but ignoring the glaring irony that it is the settlers themselves who enjoy the privileges of the discriminatory system imposed by the Israeli occupation. (2)

For updates and next steps on Ezra's case, please go here: http://www.supportezra.net/

Today, the first two young Israeli conscientious objectors of the class of 2010 faced the consequences of their refusal to serve in the Israeli army. Efi Brenner was sent to his first ten days of jail, and at press time was being held in solitary confinement. Or Ben-David is under arrest, awaiting her sentence.

The 2010 Shministim letter of refusal states in part:

Out of sense of responsibility and concern for the two nations that live in this country, we cannot stand idle. We were born into a reality of occupation, and many of our generation see this as a "natural" state. In Israeli society it is a matter of fact that at 18, every young man and woman partakes in military service. However, we cannot ignore the truth - the occupation is an extreme situation, violent, racist, inhuman, illegal, non democratic, and immoral, that is life threatening for both nations. We that have been brought up on values of liberty, justice, righteousness and peace cannot accept it." (3)

Please go here to get updates on the Shministim of 2010: http://www.shministim.com

These are just some of the faces of the people imprisoned because of their resistance to the Israeli occupation. There are, of course, countless more. Last summer, the prisoners' support and human rights organization Addameer published a report documenting the arrests of demonstrators and human rights defenders. (4)

This has been a difficult week, but make no mistake -- the struggle is not over. We take comfort on Nelson Mandela's words, "In my country we go to prison first and then become President."
