Criminalizing Criticism of Israel

The End of Free Speech?

by Paul Craig Roberts

CounterPunch
7 May 2009

On October 16, 2004, President George W. Bush signed the Israel Lobby’s
bill, the Global Anti-Semitism Review Act. This legislation requires the US
Department of State to monitor anti-semitism world wide.

To monitor anti-semitism, it has to be defined. What is the definition?
Basically, as defined by the Israel Lobby and Abe Foxman, it boils down to
any criticism of Israel or Jews.

Rahm Israel Emanuel hasn’t been mopping floors at the White House. As
soon as he gets the Hate Crimes Prevention Act of 2009 passed, it will become
a crime for any American to tell the truth about Israel’s treatment of
Palestinians and theft of their lands.

It will be a crime for Christians to acknowledge the New Testament’s account
of Jews demanding the crucifixion of Jesus.

It will be a crime to report the extraordinary influence of the Israel Lobby
on the White House and Congress, such as the AIPAC-written resolutions
praising Israel for its war crimes against the Palestinians in Gaza that
were endorsed by 100 per cent of the US Senate and 99 per cent of the House
of Representatives, while the rest of the world condemned Israel for its
barbarity.

It will be a crime to doubt the Holocaust.

It will become a crime to note the disproportionate representation of Jews
in the media, finance, and foreign policy.

In other words, it means the end of free speech, free inquiry, and the First
Amendment to the Constitution. Any facts or truths that cast aspersion upon
Israel will simply be banned.

Given the hubris of the US government, which leads Washington to apply
US law to every country and organization, what will happen to the
International Red Cross, the United Nations Commission on Human Rights,
and the various human rights organizations that have demanded
investigations of Israel’s military assault on Gaza’s civilian population? Will
they all be arrested for the hate crime of “excessive” criticism of Israel?

This is a serious question.

A recent UN report, which is yet to be released in its entirety, blames Israel
for the deaths and injuries that occurred within the United Nations
premises in Gaza. The Israeli government has responded by charging that the
UN report is “tendentious, patently biased,” which puts the UN report into
the State Department’s category of excessive criticism and strong anti-Israel
sentiment.

Israel is getting away with its blatant use of the American government to
silence its critics despite the fact that the Israeli press and Israeli soldiers have
exposed the Israeli atrocities in Gaza and the premeditated murder of
women and children urged upon the Israeli invaders by rabbis. These acts
are clearly war crimes.

It was the Israeli press that published the pictures of the Israeli soldiers’
T-shirts that indicate that the wilful murder of women and children is now
the culture of the Israeli army. The T-shirts are horrific expressions of
barbarity. For example, one shows a pregnant Palestinian woman with a
crosshairs over her stomach and the slogan, “One shot, two kills.” These
T-shirts are an indication that Israel’s policy toward the Palestinians is one
of extermination.

It has been true for years that the most potent criticism of Israel’s
mistreatment of the Palestinians comes from the Israeli press and Israeli
peace groups. For example, the Israeli newspaper Haaretz and Jeff Halper of
ICAHD have shown a moral conscience that apparently does not exist
in the Western democracies where Israel’s crimes are covered up and even
praised.

Will the American hate crime bill be applied to Haaretz and Jeff Halper?
Will American commentators who say nothing themselves but simply report
what Haaretz and Halper have said be arrested for “spreading hatred of
Israel, an anti-semitic act”?

Many Americans have been brainwashed by the propaganda that
Palestinians are terrorists who threaten innocent Israel. These Americans
will see the censorship as merely part of the necessary war on terror. They
will accept the demonization of fellow citizens who report unpalatable facts
about Israel and agree that such people should be punished for aiding
and abetting terrorists.

A massive push is underway to criminalize criticism of Israel. American
university professors have fallen victim to the well organized attempt
to eliminate all criticism of Israel. Norman Finkelstein was denied tenure at a
Catholic university because of the power of the Israel Lobby. Now the
Israel Lobby is after University of California (at Santa Barbara,) professor
William I. Robinson. Robinson’s crime: his course on global affairs included
some reading assignments critical of Israel’s invasion of Gaza.

The Israel Lobby apparently succeeded in convincing the Obama Justice (sic)
Department that it is anti-semitic to accuse two Jewish AIPAC officials,
Steven Rosen and Keith Weissman, of spying. The Israel Lobby succeeded in
getting their trial delayed for four years, and now Attorney General Eric
Holder has dropped charges. Yet, Larry Franklin, the DOD official accused of
giving secret material to Rosen and Weissman, is serving 12 years and 7
months in prison.

The absurdity is extraordinary. The two Israeli agents are not guilty of
receiving secrets, but the American official is guilty of giving secrets to them!
If there is no spy in the story, how was Franklin convicted of giving
secrets to a spy?

Criminalizing criticism of Israel destroys any hope of America having an
independent foreign policy in the Middle East that serves American
rather than Israeli interests. It eliminates any prospect of Americans escaping
from their enculturation with Israeli propaganda.

To keep American minds captive, the Lobby is working to ban as anti-semitic
any truth or disagreeable fact that pertains to Israel. It is permissible to
criticize every other country in the world, but it is anti-semitic to criticize
Israel, and anti-semitism will soon be a universal hate-crime in the Western
world.

Most of Europe has already criminalized doubting the Holocaust. It is a
crime even to confirm that it happened but to conclude that less than 6
million Jews were murdered.

Why is the Holocaust a subject that is off limits to examination? How could
a case buttressed by hard facts possibly be endangered by kooks and
anti-semitics? Surely the case doesn’t need to be protected by thought control.

De Israelische Terreur 853

Dear all,

As widely expected, TAU has issued an official statement confirming that they "cannot and will not" expel me based on my political views and activism.

The anti-boycott lobby will now jump to use this as a weapon in their increasingly desperate attempts to fend off the growing threat of academic boycott of Israeli academic institutions, arguing that these institutions respect the academic freedom "even" of boycott advocates.

Other than the evident trivialization of academic freedom implied in such a claim (ignoring all the arguments about suppression of real academic freedom in doing academic work on "problematic" topics, as Oren Ben-Dor, Ilan Pappe, Tanya Reinhart and many others have argued), it misses the point completely on why PACBI, BRICUP, USACBI, among many other small academic boycott groups in France, Spain, Belgium, Norway, Australia, South Africa, etc., have called for a boycott of Israeli academic institutions. The well documented complicity of Israel's academic institutions in the state's colonial and racist policies remains THE main factor standing behind the boycott call. Whether TAU expels me or not, this compelling factor remains true. Expelling me would have added just a bit more fuel to an already blazing fire!

For one of the earliest refutation of the "academic freedom" argument against the boycott, see:

Omar Barghouti

Tel Aviv University

OFFICE OF THE PRESIDENT

May 3, 2009

Dear Governors and Friends,

I am writing to you to clarify the University’s standing on the recent debate regarding Omar Barghouti, a Tel Aviv University master’s student of philosophy.

Mr. Barghouti is leading an international campaign to boycott Israeli universities, despite being a student at one of those universities.

A university campus should be a place that encourages and tolerates free speech, no matter how offensive the expressed opinions may be to the majority of students and faculty at that institution, or indeed to the public at large.

Our university has adopted a similar policy also in previous occasions. Moreover, if legal issues are involved, a university does not have the authority to prosecute individuals. Rather, such a matter should be pursued by the State through legal channels.

In response, therefore, to the petition calling for the expulsion of Mr. Barghouti that will be submitted to us in the near future, the University cannot and will not expel this student based on his political views or actions. He will be assessed only on the basis of his academic achievements and excellence.

I thank you for your time, and look forward to seeing many of you in May at the annual Board of Governors meeting.

Yours faithfully,

Prof. Zvi Galil

Dr. Saeb Erakat on Benjamin Netanyahu’s speech to AIPAC

Chief Palestinian Negotiator Saeb Erakat today commented on Prime Minister Netanyahu’s speech to AIPAC, in which Netanyahu called for a ‘fresh approach’ to peace between Palestinians and Israelis.

“Successive Israeli governments have failed to implement their obligations under existing agreements. When Netanyahu speaks of a fresh approach to peace, implementing Israel’s obligations under existing agreements is precisely the fresh approach that Palestinians and the international community expect of his government,” Dr Erakat said.

“This includes an immediate freeze on all settlement activity, particularly in and around occupied East Jerusalem, and lifting all restrictions on freedom of movement and access for Palestinians both in and out of, as well as within, the occupied Palestinian territory, including an immediate end to the siege on Gaza.”

“And Netanyahu must explicitly endorse the establishment of an independent, viable and sovereign Palestinian state, which remains the cornerstone of the two-state solution. Negotiations for their own sake, without a clearly defined end goal, are no substitute for a just and lasting peace.”

“A commitment to past agreements, and implementation of Israel’s existing obligations, will create the environment needed to rebuild the legitimacy and credibility of the peace process, and send a message that the Palestinians have a partner for peace.”

Dr Erakat said that economic prosperity for Palestinians rested on Israel ending its occupation.

“Economic development is a right to which Palestinians are entitled, but which they have been denied as a result of Israel’s occupation,” Dr Erakat said.

Israel’s regime of checkpoints, road blocks, permits, settlements and the construction of Israel’s Wall, which fragment the occupied Palestinian territory into isolated cantons and strangle all freedom of movement for goods and people, remains the major obstacle to economic development for Palestinians.”

“Without a political settlement, meaning an end to Israel’s occupation and the establishment of an independent and viable Palestinian state, talk of economic peace will be seen for what it is, namely an attempt to normalize and better manage the occupation.”

Solo Video Journalism
27, June 2009
Our next condensed solo video journalism course will run for 5 days from 15th -19th June 2009

The course contains two main elements:
-Camera craft and shooting sequences for the edit - combines theory and practical daily shooting exercises with regular feedback and critique
-Editing with Final Cut Pro - taking the rushes generated while shooting participants learn how to create final rough cuts

With increasing demands on journalists to be multi-skilled and be able to shoot video themselves, these courses gives instruction on working as an independent, solo broadcaster. This course have been developed in response to the increasing demands on journalists to become multi-skilled and embrace the rise of video journalism. It is taught using a mixture of theory, hands-on practical training and constructive feedback suitable for budding short documentary makers and journalists wanting to widen their skills base

A previous participant who has just taken the course in May says:
"This was a hugely enjoyable learning experience. The teachers were very knowledgeable and taught using examples from the real world, such as filming a documentary on Robbie Williams, being in Iraq with John Simpson or editing a commercial for Toyota. I think it provided a great base line understanding of the principles involved that will enable me to improve the A/V output for Wardour in the future." - Phil Pemberton, Managing Editor, Wardour

Klimaatverandering 145

Nederlandse vertaling van het Transition Handbook verschijnt

Utrecht, 7 mei 2009 -

initiatiefnemers in vijftig grote en kleine plaatsen;

bronnen.
website: http://www.hitte.nu/transitie.html

14 mei 2009: Film 'Jerusalem the East Side story' in Culemborg

Georganiseerd door de Steungroep Houd Hoop Levend - Plant een Olijfboom in Culemborg

Om 20.00 uur in Wijkcentrum de Salamander, Heimanslaan 2, Culemborg

 Jerusalem... the East Side Story

16 MEI 2009 - Discussie: NAAR EEN OP RECHTEN GEBASEERDE OPLOSSING IN PALESTINA in Amsterdam

Palestinian and Israeli Human Rights Organisations Release Joint Fact
Sheet Calling for an End to International Donor Complicity in Israeli
Violations of International Law

On 2 March 2009, major international donors convened in Sharm al-Sheikh
to collectively respond to the destruction caused by Israel’s 23 day
military offensive on the Gaza Strip. During the conference, a total of
$4.5 billion was pledged in reconstruction funds for Gaza. In light of
the extensive destruction across the Gaza Strip, especially the
destruction of civilian homes and infrastructure, reconstruction is urgent.

However, as Palestinian and Israeli human rights organisations, we must
note that by agreeing to reconstruction without specific, binding
assurances from the State of Israel, international donors are
effectively underwriting Israel’s illegal actions in the occupied
Palestinian territory (oPt). International law – including,
international human rights law, international humanitarian law (IHL),
and the law of state responsibility for wrongful acts – places specific,
binding obligations on the State of Israel (based, inter alia, on its
duties as an Occupying Power) with respect to the maintenance and
development of normal life in occupied territory. By repeatedly
restricting their action to providing aid, without holding Israel
accountable for its specific obligations, international donors are
relieving Israel of its legally binding responsibilities.

Individual donor States – as High Contracting Parties to the Geneva
Conventions – are under an obligation to ensure respect for the
Conventions at all times. They are also bound by international law which
prohibits complicity in internationally wrongful acts. By repeatedly
covering the cost of the occupation, without demanding accountability
from Israel, the international community is implicitly encouraging
violations of international law perpetrated by Israeli forces in
occupied territory: individual donor States may thus be acting contrary
to their own legal obligations.

We are concerned that such action negatively impacts upon respect for
the rule of law, and is in violation of States’ legal obligations.
Ultimately, the continuation of this policy may reduce the protections
afforded to civilian populations, further exposing them to violations of
the laws of war.

The legal and contextual situation relating to this issue has been
outlined in a joint fact sheet, ‘Human Rights Organisations Call for an
End to International Donor Complicity in Israeli Violations of
International Law’, released today.'

Nieuwsbrief mei 2009

sterBeste Lezers,

Ieder mens, ieder kind is uniek.

The Office of the High Commissioner for Human Rights in the occupied Palestinian territory (OHCHR-oPt) called for an immediate halt to the recent wave of eviction orders and demolitions of Palestinian houses in the occupied territory, adding that the demolitions and forced evictions, as practiced in the oPt, are in violation of the International Covenant on Economic, Social and Cultural Rights. This phenomenon is of particular concern in East Jerusalem, where hundreds of people are threatened with forcible eviction, house demolition and displacement, OHCHR said.

Palestinian christian family counters harassment with openness

"A land is nothing without people, and people are nothing without a land." That's the maximfollowed by Palestinian farmer Daoud Nassar. And when he speaks of the intimate connectionbetween people and their land, he is talking from hard-won experience.

Nassar, a Palestinian Christian, lives with his family on 42 hectares (100 acres) of fertile land west of Bethlehem. His grandfather bought the land in 1916, and the Nassar family hasfarmed there ever sincegrowing olivesalmondsgrapespears and figs. In 1991, DaoudNassar learned that the Israeli authorities were planning to confiscate three quarters of hisland – a practice that is illegal under international lawbut nonetheless widespread on the West Bank. Since then, the family has been locked in a costly legal battle with the Israeligovernmentdespite possessing all the land registration documents and other paperworknecessary to prove their ownership of the land, Daoud Nassar told a visiting ecumenicaldelegation on 10 March.

Jewish Voice for Peace: politieke intimidaties van vredesactivisten moet stoppen!

Dear,

Let me cut down to the chase. We have just learned that a number of Israeli peace activists have had their computers confiscated, have been called for interrogations, and have only been released upon signing agreements not to contact their political friends for 30 days. The activists targeted are members of New Profile, a group of feminist women and men daring to suggest that Israel need not be a militarized society. They are being wrongfully accused of inciting young people--like the shministim--not to enlist in the army. The charge is not true. While New Profile does not tell youngsters not to enlist, they certainly support those who do not: pacifists, those who oppose the occupation, and others. New Profile informs them of their rights and gives them legal support when necessary. But Israel is a country that does not acknowledge the basic human right to conscientious objection.

sterNIEUWS Gaza rapport

International Crisis Group: Gaza’s Unfinished Business

Gaza's Unfinished Business, the latest report from the International Crisis Group, argues that the fundamental crisis today is not humanitarian but political. If the siege remains, Hamas could launch large-scale attacks. If weapons smuggling and rocket fire persist, Israel could mount a new offensive. Without some Palestinian unity, Gaza’s rebuilding will not begin. In short, defusing this crisis requires a sustainable Israel-Hamas ceasefire, Gaza’s reconstruction and Palestinian reconciliation.

The war galvanised the world’s attention, but three months later, urgency has given way to complacency and complacency to neglect. Delinking a ceasefire from a prisoner exchange might be politically costly for Israel's Prime Minister Netanyahu, but it is necessary. "A ceasefire is a vital first step", says Nicolas Pelham, Crisis Group Senior Analyst. "It will be difficult to achieve, but its components are obvious: Gaza’s borders need to open, the rockets need to stop, and some form of third party monitoring must take place".

sterNIEUWS Ondervoeding kinderen Gaza

OPT: Signs of worsening malnutrition among children
GAZA CITY, 21 April 2009 (IRIN) - Rising poverty, unemployment and food insecurity in Gaza, compounded by the recent 23-day Israeli offensive, have increased the threat of child malnutrition, say UN agencies, health ministry officials and healthcare NGOs in Gaza. UN World Health Organization (WHO) officials are concerned by the warning signs, including rising malnutrition indicators - like increased cases of stunting, wasting and underweight children - and continuing high rates of anaemia among children and pregnant women.
A Food and Agriculture Organization (FAO)/World Food Programme (WFP) qualitative food security assessment for Gaza in 2008 and early 2009 points to increasing food insecurity compared to 2007, said FAO food security adviser Erminio Saco based in Jerusalem; and according to the Palestinian Central Bureau of Statistics (PCBS) food acquisition and energy consumption in Gaza declined by 10 percent between 2005 and 2007.

sterNIEUWS Watergebruik

Wereldbank: rapport over watergebruik in Palestijnse gebieden en Israël
The World Bank published a report today entitled Assessment of Restrictions on Palestinian Water Sector Development.  The report is the Bank’s first on the issue of water in the West Bank and Gaza (WBG). Together with two other recent reports, examining access to West Bank land and to telecommunication frequencies, it provides comprehensive insight into a critical, but largely unaddressed component of the economic restrictions impeding Palestinian economic development -- limited access to natural resources.
Noting the complete dependence of WBG on scarce water resources shared and largely controlled by Israel, the report finds that the joint governance rules and water allocations established under the 1995 Oslo interim agreement, still in effect today, fall short of the needs of the Palestinian people. Because of the imbalance in power, capacity and information between parties, interim governance rules and practices have resulted in systematic and severe constraints on Palestinian development of water resources, water uses, and wastewater management. Furthermore, since 2000, the Israeli-imposed movement and access restrictions, consisting of physical impediments, but also of permitting and decision-making practices, have further impaired Palestinian access to water resources, infrastructure development and utility operations.

Pausvergunning

IDF draft dodgers are heroes, not criminals

By Dideon Levy

Yitzhak Laor, our best protest poet, may soon face arrest. On Independence Day eve he published a poem in Haaretz's literary supplement with the lines: "Perhaps shame prevents me from getting up to embrace my son / And warning him of those who want to enlist him." Arresting Laor for having written such lines may sound like fiction, but something similar has already happened. Last week nine activists from New Profile, a feminist-pacifist organization formed in 1998 that aims to demilitarize Israeli society, were arrested on suspicion of incitement and assisting draft dodgers. The police raided their homes and confiscated their computers. The military advocate general requested the raid, the attorney general obliged and the police carried it out.

Independence Day article

By  Amaya Galil, Zochrot

"Where will you be for the holiday? Are you going to the celebrations in town? To a picnic in the Carmel Forest? It’s really beautiful there! Won’t you come? Everyone’s going." A few years ago I would have joined them; a picnic out in the country – what could be wrong with that? But something changed. People around me are celebrating, but I’m not.

Once, at one of the picnics, I came across the remains of an old building with a blue dome. I discovered that it had belonged to the village of Ein Ghazal. IDF soldiers expelled its Palestinian residents on 26.7.1948, Israel prevented them from returning, and planted theCarmel Coast Forest among the ruins of the buildings it demolished. It was difficult to see the remains, but once I did I could no longer ignore them - the ruins of villages where people lived until 1948.

If I were a Palestinian

By Akiva Eldar

In a moment of candorEhud Barak once said: "If I were a Palestinian of the right age, I would join, at some point, one of the terrorist groups."

If I were a Palestinian, of any age, I would declare an all-out war on all terrorist groups andfulfill the demand of the Jews to recognize the State of Israel as the state of the Jewish people. Furthermore, as a present on the birthday of the Jewish people, as it completes 61 years of existence, I would announce that I also respect its Declaration of Independence of May 14, 1948. I would do this on the condition that all the state's principles, to the last one, apply to the territories controlled by the Jewish state - to every last foot of territory.

Gaza, remember?

By Gideon Levy

Alyan Abu-Aun is lying in his tent, his crutches beside him. He smokes cigarettes and stares into the tiny tent's empty space. His young son sits on his lap. Ten people are crammed into the tent, about the size of a small room. It has been their home for three months. Nothing remains of their previous home, which the Israel Defense Forces shelled during Operation Cast Lead. They are refugees for a second time; Abu-Aun's mother still remembers her home inSumsum, a town that once stood near Ashkelon.

Abu-Aun, 53, was wounded while trying to flee when his home in the Gaza town of Beit Lahiawas bombed. He has been on crutches ever since. His wife gave birth during the height of the war, and now the baby is with them in the cold tent. The tent was sent flying during the storm that devoured the Gaza Strip on Wednesday, so the family had to put it back up. They receive water only occasionally in a container, and a tiny tin shack serves as a bathroom for the 100 families in this new refugee camp, 'Camp Gaza,' in Beit Lahia's Al-Atatra neighborhood. Abu-Aun sounded particularly bitter this past weekend; the Red Cross refused his family a bigger tent. He has also had enough of eating beans.
